Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the HouseQuest, Skidattl, HiQ, and Lyv Technologies platforms, websites, mobile applications, HouseQuest Matching Intelligence, HiQ matching and recommendation tools, augmented reality experiences, APIs, and related products and services, whether offered under the HouseQuest, Skidattl, HiQ, Lyv Technologies, or other related brand names (collectively, the "Services"). The Services are provided by Lyv Technologies Inc., a Delaware corporation doing business under the HouseQuest, Skidattl, and HiQ names and brands ("Company," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. Please review them carefully before using the Services.
2. Eligibility
You must be at least eighteen (18) years old and legally capable of entering into a binding agreement. By using the Services, you represent that you satisfy these requirements.
3. Accounts and Registration
Certain portions of the Services may be available without registration. Registration may be required to save homes, searches, alerts, Matching Intelligence results, contact agents, request tours, participate in community features, or access additional functionality. You agree to provide accurate information and maintain the confidentiality of your account credentials.
4. Description of Services
The Company provides tools designed to help users discover, evaluate, and engage with homes, neighborhoods, communities, businesses, and real estate professionals. Features may include property discovery, recommendations, spatial experiences, augmented reality visualizations, compatibility scoring, communications tools, and market insights. The Company may modify, suspend, or discontinue any portion of the Services at any time. The Services may include sponsored content, promotional opportunities, advertising, recommendations, and other commercial offerings. The Company may use information about user interests, preferences, persona dimensions, compatibility characteristics, and interactions with the Services to personalize content, recommendations, sponsorships, promotions, and advertising displayed within the Services.
5. Property Information Disclaimer
Property information may originate from MLS systems, public records, tax assessors, government agencies, homeowners, real estate professionals, users, licensors, and third parties. The Company does not guarantee that any information is complete, accurate, current, available, or suitable for any purpose. Users are responsible for independently verifying information before making real estate, financial, legal, or investment decisions.
6. HouseQuest Matching Intelligence
HouseQuest Matching Intelligence uses questionnaires, user inputs, algorithms, artificial intelligence, behavioral information, and other data sources to generate compatibility scores, rankings, personas, explanations, and recommendations. These outputs are informational tools only and are not guarantees of satisfaction, transaction outcomes, investment performance, lifestyle fit, or any other result. Users remain solely responsible for their decisions.
7. Location-Based and Augmented Reality Experiences
Certain Services use GPS, parcel data, building footprints, mapping technologies, location services, cameras, sensors, and augmented reality. Such information may be inaccurate, delayed, incomplete, unavailable, or imprecise. Visual overlays may not perfectly correspond to real-world conditions. Users remain responsible for personal safety, awareness of surroundings, compliance with laws, and respecting private property. Use of certain features may result in increased consumption of battery power, mobile data, processing resources, storage capacity, device temperature, or other device resources. The User acknowledges and accepts that such impacts may occur as a result of location services, camera usage, augmented reality features, mapping functions, and other computationally intensive aspects of the Services.
8. Acceptable Use
You agree to use the Services only for lawful purposes. You may not violate laws, harass others, impersonate others, submit false information, falsely claim ownership of property, manipulate ratings or reviews, gain unauthorized access to systems, interfere with operations, introduce malware, scrape data, harvest information, or engage in fraudulent conduct. The Company may investigate suspected violations and may suspend or terminate access at any time.
Users may not use multiple accounts, automated systems, scripts, bots, crawlers, emulators, devices, proxies, VPNs, or other techniques to circumvent usage limits, conceal identity, collect information at scale, analyze proprietary systems, derive recommendation methodologies, facilitate competitive intelligence gathering, or otherwise access the Services in a manner inconsistent with their intended purpose.
9. User-Generated Content
The Services may permit users to submit reviews, ratings, comments, photographs, corrections, owner-submitted updates, and other content. You retain ownership of content you submit. By submitting content, you grant the Company a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, analyze, display, distribute, and use such content to operate, improve, promote, train, and develop the Services and HouseQuest’s Matching Intelligence. The Company may remove, edit, restrict, or disable content at any time.
10. MLS and Licensed Data
Certain information may be subject to restrictions imposed by MLS organizations, data licensors, and third-party providers. Users may not republish, redistribute, resell, create competing databases from, or otherwise misuse licensed content. Users may not use licensed content to train artificial intelligence systems where prohibited by applicable agreements.
11. Intellectual Property and Proprietary Systems
The Services, including software, interfaces, branding, trademarks, logos, databases, content, reports, visualizations, algorithms, HouseQuest Matching Intelligence, persona frameworks, compatibility dimensions, recommendation systems, scoring methodologies, taxonomies, analytics, visual designs, explanatory content, and related intellectual property, are owned by the Company or its licensors and are protected by copyright, trademark, trade secret, patent, and other applicable laws.
HouseQuest Matching Intelligence, including its personas, dimensions, compatibility frameworks, recommendation methodologies, scoring systems, explanatory models, ranking systems, and related outputs, constitutes proprietary intellectual property of the Company.
Except as expressly permitted by the Company, users may not copy, reproduce, modify, distribute, publish, display, create derivative works from, reverse engineer, decompile, disassemble, benchmark, analyze, extract, scrape, harvest, or otherwise attempt to derive the source code, algorithms, methodologies, models, scoring systems, personas, dimensions, recommendation logic, compatibility frameworks, or other proprietary aspects of the Services.
Users may not use the Services, outputs, recommendations, personas, compatibility information, explanations, content, or data generated by the Services to develop, train, improve, validate, benchmark, support, or operate any competing product, service, database, recommendation system, artificial intelligence system, matching system, analytics platform, or similar offering.
The Company reserves all rights not expressly granted in these Terms.
Unauthorized use of the Services or the Company’s proprietary systems may result in suspension or termination of access, legal action, injunctive relief, damages, and any other remedies available under applicable law.
12. Aggregated and Derived Data
The Company may create, analyze, use, publish, license, sell, and otherwise commercialize aggregated, anonymized, de-identified, benchmark, statistical, predictive, and market-intelligence information derived from operation of the Services. The Company will not sell information identifying a specific individual user's viewing history, location history, questionnaire responses, property preferences, or Matching Intelligence profile. The Company may use user interests, preferences, persona dimensions, compatibility characteristics, behavioral patterns, and interactions with the Services to determine which content, recommendations, sponsorships, promotions, and advertisements may be most relevant to a user. The Company does not sell, disclose, or provide advertisers with information identifying an individual user's questionnaire responses, persona profile, compatibility scores, lifestyle characteristics, or other personal information unless the user expressly authorizes such sharing.
13. Third-Party Services
The Services may integrate with MLS systems, mapping providers, analytics providers, artificial intelligence providers, communication providers, and other third parties. The Company is not responsible for third-party services, content, policies, or practices.
14. Agent and Brokerage Connections
The Company may facilitate connections between users and real estate professionals. The Company does not guarantee representation, availability, responsiveness, qualifications, transaction outcomes, or results.
15. Suspension and Termination
The Company may suspend, restrict, or terminate access if these Terms are violated, fraudulent activity is suspected, user conduct threatens the Services or other users, or termination is required by law or licensing obligations.
16. Termination by User
You may terminate your account at any time through account deletion tools or by contacting the Company. The Company may retain information as required by law, for security purposes, licensing compliance, dispute resolution, or business records. Aggregated and de-identified information may continue to be retained and used.
17. Safety and Real-World Activity
The Company encourages exploration of real-world locations, neighborhoods, properties, businesses, and communities. Users must remain attentive to their surroundings and not allow use of the Services to distract from safe conduct. Users are responsible for obeying traffic laws, avoiding dangerous situations, respecting private property and property occupants, exercising reasonable judgment, and determining whether a location is safe, appropriate, and legally accessible. The Company does not direct users to enter private property and does not authorize trespassing. Users are solely responsible for determining whether a property, location, or area may be lawfully accessed or viewed. The Company is not responsible for injuries, accidents, vehicle collisions, pedestrian incidents, property damage, disputes with property occupants, or other consequences arising from real-world use of the Services. You assume all risks associated with visiting, viewing, exploring, or interacting with locations, properties, neighborhoods, businesses, communities, and individuals in connection with the Services.
18. Additional Indemnification for Real-World Activities
You agree to indemnify, defend, and hold the Company harmless from claims, damages, liabilities, losses, costs, or expenses arising from your physical activities, conduct, interactions, property access decisions, travel decisions, or other real-world use of the Services.
19. Disclaimer of Warranties
THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE.' TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
20. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
21. Indemnification
You agree to defend, indemnify, and hold the Company harmless from claims arising from your use of the Services, your content, your violation of these Terms, or your violation of law or third-party rights.
22. Arbitration and Class Action Waiver
Any dispute arising from these Terms or the Services shall be resolved through binding arbitration except where prohibited by law. Users waive any right to participate in a class action or representative proceeding.
23. Force Majeure
The Company shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, internet outages, cloud-service failures, utility failures, labor disputes, government actions, war, terrorism, or similar events.
24. Assignment
The Company may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets. Users may not assign their rights without the Company's consent.
25. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
26. Entire Agreement
These Terms, together with the Company’s Privacy Policy, constitute the entire agreement between the Company and the user regarding the Services.
27. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona.
28. Electronic Communications
By using the Services, you consent to receive notices, disclosures, agreements, updates, and other communications electronically. Electronic communications satisfy any legal requirement that such communications be in writing.
29. Copyright Complaints
The Company respects intellectual property rights and may remove content alleged to infringe copyrights or other intellectual property rights. Copyright complaints may be submitted using the contact information provided in these Terms.
30. Content Removal and Takedown Requests
The Company reserves the right to remove, disable, restrict, or investigate content that it believes violates these Terms, infringes intellectual property rights, violates applicable law, or may create liability for the Company.
31. Change to These Terms
The Company may modify these Terms from time to time. Continued use of the Services constitutes acceptance of revised Terms.
32. Relationship to Privacy Policy
Collection, use, sharing, retention, and protection of information are governed by the Company’s Privacy Policy, which should be read together with these Terms.
